A key problem stems from the fact that consumers may perceive different marketing claims as equally relevant and credible, regardless of the level of scientific validity on which they are based. At the same time, certain claims may be the result of rigorously conducted research and a systematic product development process, while others may represent primarily a marketing interpretation of a limited number of observations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, there is a big difference between a thoroughly tested cosmetic product and a product whose claims are based solely on subjective impressions. Increasingly, this difference determines not only consumer confidence but also producer safety during regulatory audits or disputes with supervisory authorities.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong><strong>Marketing claims as legal responsibility in the cosmetics industry<\/strong><\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A few years ago, many brands treated marketing claims just as creative elements of sales communication. Today the situation is completely different. Regulations (EC) No 1223\/2009 of the European Parliament and of the Council of 30 November 2009 on cosmetic products and Commission Regulation (EU) No 655\/2013 of 10 July 2013 laying down common criteria for the justification of claims used in relation to cosmetic products explicitly state that any claim regarding the effectiveness of cosmetics must be supported by adequate and verifiable evidence. In the Republic of Serbia, this area is regulated by the Regulation on cosmetic products (&#8220;Official Gazette of RS&#8221;, no. 60\/2019, 47\/2022, 21\/2023 and 25\/2026).This means that a manufacturer cannot use a message that suggests a particular mechanism of action or cosmetic benefit without having a complete dossier confirming its validity. This is exactly where the role of application and instrumental testing begins. The consumer&#8217;s perception is not consistent: while in certain situations the marketing claim about the product&#8217;s effectiveness may be accepted based on the communication itself, in other situations it may require concrete, objective and scientifically based evidence that confirms its credibility.<\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter size-full is-resized\"><img loading=\"lazy\" decoding=\"async\" width=\"576\" height=\"108\" src=\"https:\/\/splaboratorija.rs\/wp-content\/uploads\/2026\/08\/image-3.png\" alt=\"\" class=\"wp-image-5601\" style=\"width:762px;height:auto\" srcset=\"https:\/\/splaboratorija.rs\/wp-content\/uploads\/2026\/08\/image-3.png 576w, https:\/\/splaboratorija.rs\/wp-content\/uploads\/2026\/08\/image-3-300x56.png 300w\" sizes=\"auto, (max-width: 576px) 100vw, 576px\" \/><\/figure>\n<\/div>\n\n\n<h2 class=\"wp-block-heading\"><strong><strong>Why standard laboratory safety testing is not enough?<\/strong><\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This represents one of the aspects of the development of cosmetic products that is most often subject to misinterpretation and insufficient understanding. A manufacturer may have a perfectly designed cream or lotion formula and excellent test results for microbiological safety, stability or package compatibility. The product can be fully legal and safe for human skin. However, all this still does not represent a basis for making specific marketing claims. Why?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Because ensuring the safety of a product and confirming its actual effectiveness are two completely different branches of cosmetic science.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Standard laboratory tests answer questions such as:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u2022 is the cosmetic formulation stable over time?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u2022 does the chemical composition remain consistent under different conditions?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u2022 does the product meet basic safety requirements regarding surfactant levels or lipid stability?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u2022 is it microbiologically correct?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In contrast to this, application tests and instrumental tests are aimed at evaluating the behavior and effectiveness of the cosmetic product in the conditions of its local application, while also examining the subjective perception and user experience of the end consumer. Therefore, the satisfactory structural and physicochemical characteristics of the formulation alone are not sufficient to support specific claims about its effect on the skin. Adequate, objective and scientifically based data are necessary for claims related to the reduction of the visibility of wrinkles, soothing effect or improvement of skin barrier function.<\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter size-full is-resized\"><img loading=\"lazy\" decoding=\"async\" width=\"576\" height=\"108\" src=\"https:\/\/splaboratorija.rs\/wp-content\/uploads\/2026\/08\/image-9.png\" alt=\"\" class=\"wp-image-5613\" style=\"width:674px;height:auto\" srcset=\"https:\/\/splaboratorija.rs\/wp-content\/uploads\/2026\/08\/image-9.png 576w, https:\/\/splaboratorija.rs\/wp-content\/uploads\/2026\/08\/image-9-300x56.png 300w\" sizes=\"auto, (max-width: 576px) 100vw, 576px\" \/><\/figure>\n<\/div>\n\n\n<h2 class=\"wp-block-heading\"><strong><strong>What do application tests really reveal?<\/strong><\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A well-designed application study is a structured process based on strict methodology, standardized conditions of use and expertly prepared questionnaires.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">During this process, the subject receives skin care products to use at home with detailed instructions regarding the frequency of product application and the duration of the test. Upon completion, they evaluate the product based on specific questions that target the manufacturer&#8217;s intended claims.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This step is crucial because application studies evaluate the performance, organoleptic and sensory properties of cosmetic formulations, such as:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u2022 consistency and texture<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u2022 odor profile and the presence of any odor allergens<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u2022 ease of local application and speed of absorption<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u2022 the immediate feeling it leaves on the skin and hair.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This makes it possible to see aspects that cannot be obtained only on the basis of the data specified in the technical data sheet of the raw material. Sometimes the formula performs exceptionally well during instrumental analysis, but users reject it because, for example, it leaves a greasy film. On the other hand, a cosmetic product may offer an amazing sensory experience, but not bring measurable improvements in skin parameters. The answer depends entirely on the claim.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the claim is &#8220;most users felt their skin was softer&#8221;, the application test provides the appropriate scientific basis. However, if the message implies a quantitative reduction of wrinkles, an improved percentage of skin elasticity, or a mechanism of action in the fight against acne, the support of an instrumental evaluation is almost always required. The line between an effective marketing message and a claim that must be reliably scientifically supported is often much smaller than it appears in the process of creating a product declaration.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong><strong>Instrumental testing: when a claim have to be quantified?<\/strong><\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Nowadays, consumers expect more and more transparency, while regulatory bodies are increasingly checking the claims made by manufacturers about their products. Such a market and regulatory environment further emphasizes the importance of advanced instrumental analysis methods.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Unlike application tests, instrumental methods do not rely on user opinions. Therefore, their substantiation requires specialized studies conducted under the direct supervision of doctors specialists.
